1. Terms and Conditions

1.1 The Terms & Conditions (hereinafter, ‘T&C’) of the loyalty cards programme (hereinafter, ‘Loyalty Programme’) relating to Italians Card (hereinafter, ‘Italians Card’) are listed below. If you have any questions about these T&C, please Contact Us on

2. The Loyalty Programme

2.1 These T&C, including the data protection provisions under clause 6, are applicable across the entire Italians Card Loyalty Programme and any participation is considered as acceptance.

2.2 Italians Card as well as the related account, app, QR codes, coupons, vouchers and points, (hereinafter, ‘Products’) whether virtual or in printed form and in whatever form, are issued by and remain the property of Italians Card Ltd (hereinafter, ‘Company’) which may, at any time, terminate the Loyalty Programme or alter or amend these T&C.

3. Membership

3.1 All members of the Loyalty Programme (hereinafter, ‘Members’) must be aged 18 years or over.

3.2 Members are only entitled to one Italians Card’ account each. The Company reserves the right to refuse, merge or close additional accounts at any time.

3.3 Members must register their personal details and keep the Company informed of any changes. The Company cannot be held responsible for any loss of points or vouchers incurred as a result of out of date details. New accounts that are not registered within two years of first being used and accounts with out of date details that have not been updated for two years may be removed and any points or vouchers forfeited.

3.4 Italians Card and any related Product, in whatever form, is not transferable, cannot be copied and can only be used by the Member who is named and registered for the card.

3.5 The Products whether virtual or in printed form and in whatever form remain the responsibility of the Member, as do any security details relating to the account. The Company cannot be held responsible for any loss arising from the member failing to ensure the safe-keeping of these items.

3.6 The Company may decline to issue, withdraw or cancel the Italians Card or the Products, whether virtual or in printed form and in whatever form, in whatever form, and/or remove a Member from the Loyalty Programme at any time where there is reasonable belief of:

  • 3.7 any abuse or attempted abuse of the Loyalty Programme;
  • 3.8 any breach or attempted breach of these T&C and/or those relating to the optional elements of the Loyalty Programme;
  • 3.9 any behaviour relating to the Company or to any company of the group of the Company that involves theft, misconduct, abusive or offensive behaviour, or supplying false or misleading information.

3.10 The Products, whether virtual or in printed form, and in whatever form, can only be used for purchases from the Company and promotional partners who are part of the Loyalty Programme.

3.11 The Loyalty Programme is only for personal and consumer use. The Products, whether virtual or in printed form and in whatever form, cannot be used for any business transaction or purpose.

3.12 The Products, whether virtual or in printed form and in whatever form cannot be transferred, bought, sold or in any way traded.

3.13 The Members may be able to express a preference for their statement, and where we have their consent, electronic statements shall be sent to their registered e-mail address or mobile phone number, unless the Members shall specifically request that the statement be sent to their registered postal address. The Company reserves the right, for business or policy reasons or other regulatory reasons to send other necessary communications to the registered email address or mobile phone number provided by the Member.

3.14 The Members can choose to leave the Loyalty Programme at any time. By leaving the Loyalty Programme, Members forfeit the right to any points or vouchers already accrued or issued.

3.15 The Members who do not collect any points for two years may be removed from the Loyalty Programme and if so will need to reapply for new membership should they wish to re-join.

3.16 The Members will not inherit the Products whether virtual or in printed form and in whatever form of a family member who has died. However, additional Members of the same family can be added, upon request, to the same Italian Card and/or Products and the relevant points can be transferred to the same account. 4. Points

4.1 The Members must present their Italian Card or Products at the checkout in order to collect points for a transaction in store. Members who forget to do this will not be able to have their points added manually.

4.2 The amount of points awarded may change and will vary depending on the products bought, the amount spent and where the transaction takes place, as well as the offers in force at the time. It is at the discretion of the Company and/or the Merchant whether to honour the offer at any time and the members obtains no legal rights by virtue of notice of or receipt of any offer.

4.3 Certain Products may be excluded from the Loyalty Programme at the discretion of the Company

4.4 The Company is entitled to promote specific/particular offers, even for a limited time-period, at any time at its discretion. Any participation in such promotional offers above and beyond what could objectively be considered consumer behaviour or personal use may be considered as abuse of the Loyalty Programme.

4.5 The Company is entitled to remove points at any time if the products are returned for any reason and a full or partial refund of the purchase price is given. This also applies to the exchange of products, unless the exchange is for products with an equivalent points value.

4.6 Points awarded at the time of the transaction or vouchers already issued may be removed or cancelled if the Company determines that the points were collected in breach of these terms and conditions or were awarded in error. For the avoidance of doubt, any advice or actions of our staff or the Merchant's staff that is contrary to these terms and conditions will not have the effect of changing these terms and conditions.

4.7 Points have no nominal value and cannot be converted into cash. They can only be redeemed at a partner of the group through a discount on the purchase, with a conversion of one point equals one penny.

4.8 The Company is under no obligation to award its points for any reason outside of qualifying transactions.

5. Points redemptions

5.1 Members will be able to redeem Italians Cards’ points when they have accumulated a combined total of them above the qualifying threshold by the end of each collection period. The current qualifying threshold is 500 points. Above the threshold, redemptions will be allowed in multiples of 500 points. The Company may, at its sole discretion, amend from time to time such thresholds without obtaining any prior consent of the Members.

5.2 The redemption of points will purely work in the form of discounts again the purchase of a new product or service in one of the Merchants that are part of the Company’s network.

5.3 The collection period (Collection Period) runs from 1/1/2016 to 31/12/2019 and shall be automatically renewed unless otherwise decided by the Company in its sole discretion. At the end of the Collection Period, points shall not be carried forward. The Italian Card is valid for two years from date of issue and is accompanied by an expiry date, beyond which it cannot be used or reissued. Additional terms and conditions may be implemented at the sole discretion of the Company.

5.4 Points are a property of the Company and have no cash value. They are not for resale/publication and valid in the EU Territory only. Valid for use only by the recipient, age restrictions apply. The Company is under no responsibility and accepts no liability for refusal (if any) by any Merchant to comply with these T&C.

6. Data Protection

6.1 The definition of “data” shall be interpreted in the light of the Data Protection Act 1998, as amended on April 1st 2016, without limitation.

6.2 The Member consents to the Company processing data provided by the Member and relating to the Member for legal, business, administrative and management purposes and in particular to the processing of any sensitive personal data (if any) (as defined in the Data Protection Act 1998) relating to the Member, including, as appropriate, in order to comply with legal requirements and obligations to third parties.

6.3 The Company may make such information available to any Company of its group or those who provide products or services to the Company or its group, regulatory authorities, and as may be required by law.

7. Limitation of liability

7.1 In no event the Company, its directors, officers, employees, agents or shareholders, be liable to Merchants, any Member or any other third party for any damages, including but not limited to general, incidental, consequential, indirect, direct, special or punitive damages, arising out of or relating to the Italians Cards or its related Products.

8. General

8.1 For the avoidance of doubt, by choosing to participate in the Loyalty Programme, Members do not enter into a contractual agreement with the Company. Nor is any partnership implied or intended. The matter shall be to the extent allowable by law one of voluntary participation in a promotional Loyalty Programme.

8.2 These T&C replace all previous versions, are correct as of the date thereof and shall be governed by and construed in accordance with the laws of England and Wales, and any disputes will be decided only by the English Courts. The Company reserves the right to change these, at any time, on reasonable notice for legal, regulatory, business or policy reasons. Such notice shall be given by indication on the website of the Company or its associated websites, and shall not require direct notice to any Member. Members who continue to participate in the Loyalty Programme following such a change will be considered to have accepted the updated terms and conditions.

8.3 Without prejudice to the above, a person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions, but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

8.4 These are the most up to date terms and conditions.

8.5 The Company reserves any right to amend the terms of these T&C in its sole discretion without obtaining the previous consent of the Members. Any amendment of these T&C shall be validly communicated to the Members by updating the present T&C on the relevant website. The Company reserves the right, but not the obligation, to communicate the changes (if any) to these T&C by email to the Members.

8.6 Italians Cards Pre-Paid MasterCard and any other subsequent cards (if any) shall be regulated by a separate and additional Terms and Conditions, which will be available through the relevant website.
